5.1 What the program is
OOMLO Creator Partners is a revenue-share program: OOMLO builds a digital product for your audience, provides a content kit, sells the product through Whop, and pays you a share of every sale, as set out in the Agreement you sign upon acceptance.
5.2 Eligibility and application
Anyone 18 or older with an audience in one of OOMLO's cores, or a fit OOMLO determines through review, may apply. OOMLO does not build for audiences of minors, sexual content, or gambling, and may decline any application at its discretion, with a reason where one is given.
5.3 No cost to you
The program has no fee, subscription, or production cost to the creator partner. OOMLO bears the cost of building the product and the kit.
5.4 The split
Your share is 50% of every sale of your product, recurring where the product recurs, unless and until it changes under the ladder mechanics of §5.5. Your share never falls below 50% while your Agreement is in effect, except as provided in §5.11 (suspension for a compliance breach).
5.5 The ladder
Your share may increase to 55% (Lead Partner) or 60% (Anchor Partner) based on sales volume and consistency thresholds OOMLO publishes and may update from time to time; increases and any reduction back toward a lower tier are based on a rolling 90-day window and require, for any reduction, that OOMLO first notify you and give you 90 days at the lower threshold before the tier changes. Temporary boosts (an additional 5 percentage points for 30 days) may apply at stated sales milestones.
5.6 Ownership and approval
OOMLO builds the product and owns the underlying production (scripts, files, page design, and the kit), except your name, voice, likeness, and any of your own original content incorporated into it, which remain yours. No product goes live under your name without your explicit approval. You may request changes before approval; OOMLO will make reasonable efforts to accommodate them.
5.7 Payment, tracking, and records
All sales, attribution, and payouts run through Whop under an affiliate relationship OOMLO establishes for you at 50% (or your then-current tier), using Whop's standard 30-day attribution window. Commissions clear 30 days after a sale, per Whop's terms, and pay out automatically to the method you configure in Whop. OOMLO relies on Whop's records as the source of truth for your sales and payouts and is not responsible for Whop's own processing errors, though OOMLO will assist you in resolving them.
5.8 Refunds on Creator Partners products
A refund of a Creator Partners product is handled through Whop under its buyer terms; the associated commission is clawed back from your balance automatically, as Whop's system provides.
5.9 Disclosure obligations
Every post referencing your Creator Partners product must include a clear and conspicuous disclosure of your affiliate relationship, using the language OOMLO provides in your kit or substantially similar language, plus the relevant platform's native disclosure label (e.g., Instagram's Paid Partnership label, TikTok's Branded Content toggle, YouTube's Paid Promotion setting). This obligation exists under FTC rules independent of this Agreement and survives its termination for any content that remains posted.
5.10 Monitoring and compliance
OOMLO monitors public posts referencing your product for disclosure compliance, at the pattern level, not as legal advice to you. A first and second missed disclosure result in a reminder; a third results in suspension of your affiliate link pending resolution, as described in §5.11.
5.11 Suspension and termination
OOMLO may suspend your affiliate override (reducing your share, including to 0%, only for the suspension period) for a compliance breach under §5.9–5.10, restoring your standard tier once resolved. Either party may terminate the Agreement with 30 days' written notice (email to the other's address of record). Termination does not affect commissions already earned on sales made before termination, which are paid on Whop's normal schedule; it does not affect your obligation to keep required disclosures on content that remains posted.
5.12 Exclusivity
Nothing in this Agreement requires exclusivity to OOMLO unless a specific Agreement states otherwise for a specific product or campaign.
5.13 Independent contractor
You are an independent contractor, not an employee, agent, or partner of OOMLO in the legal-partnership sense. You are responsible for your own taxes on commissions earned; OOMLO will issue any tax forms required by US law for payments it makes directly, and Whop is responsible for reporting related to payments it processes.
5.14 Amendments
OOMLO may update these Creator Partner Terms; material changes affecting active partners take effect 30 days after notice by email, during which you may terminate under §5.11 without penalty if you do not accept the change.
5.15 Governing law
These Creator Partner Terms and the Creator Partner Agreement are governed by the laws of the State of New Mexico.
